These Terms apply to website visitors and customers. We may update these Terms from time to time by publishing a revised version and updating the “Last updated” date.

Changes apply prospectively from the date they are published. They will not retrospectively alter the terms that applied to an order we accepted before the changes took effect, unless the change is required by law or agreed with you.

By placing an order, you confirm that you are at least 18 years old or have the permission of a parent or legal guardian and are capable of entering into a binding agreement.

Maison Sheli products are produced in limited quantities and small batches. Availability may change and we may discontinue a product at any time before an order for that product is accepted.

We aim to present product descriptions, measurements and images accurately. Because many pieces are hand-painted in small batches, subtle variations in glaze, tone, brushwork or form may occur.

These inherent variations are not necessarily faults, provided the product remains of acceptable quality, matches its description and complies with the consumer guarantees under the Australian Consumer Law.

Colours may also appear differently depending on individual screen settings. This does not exclude any rights where a product is materially different from its description or sample.

All prices are displayed in Australian dollars. Prices include any taxes required to be included by law. Any applicable delivery charges will be clearly displayed before you complete your purchase.

We may change prices prospectively at any time. A price change will not affect an order that we have already accepted.

By placing an order, you confirm that:

• The information you provide is accurate and complete.
• You are authorised to use the selected payment method.

Submitting an order constitutes an offer to purchase. An order is accepted when we send confirmation that it has been accepted or dispatched.

We may decline or cancel an order before acceptance where a product is unavailable, payment cannot be authorised, fraud is reasonably suspected, delivery is unavailable to the supplied address, purchase limits have been exceeded, or an obvious pricing or website error has occurred.

If we cancel an order after receiving payment, we will provide a full refund to the original payment method.

Shipping rates, methods and estimated delivery times are outlined in our Shipping Policy. Delivery timeframes are estimates and may be affected by events outside our reasonable control.

If a material delay occurs, please contact us and we will assist in investigating the shipment. Nothing in this section limits any rights available under the Australian Consumer Law.

Returns, refunds and other remedies are governed by our Returns & Refunds Policy and the Australian Consumer Law.

Nothing in these Terms limits or excludes any consumer right or remedy that cannot lawfully be limited or excluded.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have goods replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Products must be used only for the purposes described on their product pages and in accordance with all care, use and safety instructions supplied with the product or published on our website.

Maison Sheli is not responsible for loss caused by misuse, improper care, unauthorised alteration, normal wear and tear, or failure to follow supplied instructions, to the extent permitted by law.

Candles must never be left burning unattended and must be kept away from children, pets, drafts and flammable materials. Customers must follow the recommended burn times, wick care and other safety directions supplied with the candle.

Nothing in this section limits your rights under the Australian Consumer Law or excludes liability that cannot lawfully be excluded.

Unless otherwise indicated, the website and its content, including text, photographs, graphics, logos, product names, designs and branding, are owned by or licensed to Maison Sheli and are protected by applicable intellectual property laws.

You may access and use the website for personal, non-commercial purposes.

You must not copy, reproduce, adapt, distribute, publish, commercially exploit or otherwise use our content without prior written permission, except as permitted by law.

If you voluntarily submit a review, photograph, comment or other content to us or through our website, you confirm that you have the right to submit it and that it does not infringe another person’s rights or breach any law.

You grant Maison Sheli a non-exclusive, worldwide, royalty-free licence to reproduce, publish, adapt and communicate that content for the purpose of operating, promoting and marketing Maison Sheli.

This licence continues unless you withdraw your permission by contacting us, except to the extent that the content has already been used in published materials or must be retained for legal or administrative purposes.

We will not imply that you endorse Maison Sheli beyond the context in which the content was submitted. Our handling of personal information contained in user content is subject to our Privacy Policy.

Our website may contain links to third-party websites. These links are provided for convenience.

We do not control and are not responsible for third-party content, availability, terms or privacy practices. You should review the applicable third-party policies before using those websites.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law.

To the extent permitted by law, Maison Sheli is not responsible for loss caused by misuse of a product, failure to follow supplied safety or care instructions, unauthorised modification, or use for a purpose for which the product was not intended.

Our Privacy Policy explains how we collect, use, disclose and protect personal information.

By providing personal information to us, you acknowledge that it will be handled in accordance with that policy and applicable law.

We are not responsible for a failure or delay in performing an obligation to the extent that it is caused by an event outside our reasonable control, such as a natural disaster, industrial action, transport disruption, supply chain interruption or government action.

This provision does not limit any non-excludable rights or remedies under the Australian Consumer Law.

If such an event materially affects an accepted order, we will contact you where reasonably practicable and work with you to provide an appropriate solution.

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be read down to the minimum extent necessary or removed, and the remaining provisions will continue to apply.

These Terms are governed by the laws of New South Wales, Australia.

The parties submit to the non-exclusive jurisdiction of the courts of New South Wales and courts entitled to hear appeals from them.

Nothing in this clause limits any right a consumer may have to bring proceedings in another competent jurisdiction.
